Privacy Policy
Effective September 1, 2026
This Privacy Policy describes how Midway (“the App”, “we”, “us”) collects,
uses, and discloses information when you use the Midway mobile application and
the midwayfair.app website (together, “the Services”). By using the Services,
you agree to the practices described in this policy.
1. Information We Collect
1.1 Information you provide
The App does not require an account and does not ask for your name, email
address, telephone number, or postal address. The only information you provide
directly is the content of a message you choose to send through the feedback
form in the App, together with the device information described in Section 1.3
if you elect to include it.
1.2 Information collected automatically
App analytics are off until you choose Share app analytics
in the one-time choice shown after onboarding or in Settings. If enabled, the
App collects a limited set of usage events, such as the App being opened, a
filter being applied, or a place or event being opened. Each event records the
type of item involved (for example, “restroom” or “live music”). Search text,
saved items, notes, and location are never included. These events are
associated with a randomly generated identifier created by the App after you
opt in.
This identifier is generated by the App, is not derived from your device or
from any information about you, and is not the Identifier for Advertisers
(IDFA) or the Identifier for Vendors (IDFV). It is stored locally and is
permanently deleted when the App is uninstalled. You may withdraw consent in
Settings at any time. Turning the setting off stops collection, deletes usage
events that are still queued on the phone, and deletes the identifier. If you
later opt in again, the App creates a new identifier that cannot be linked to
the old one.
1.3 Community pin corrections
If you choose to report a pin or move one and confirm the correction, the
App sends the place identifier, place name, category, existing map point and,
for a move, your proposed map point. It also sends a separate randomly
generated app-install identifier so repeated reports can be grouped and
independent reports can be prioritized.
The confirmation screen describes this before anything is sent. A pin
correction never contains your live location, blue-dot position, walking
history, saved items, or notes. The correction identifier is not derived from
your device, is not used for general usage analytics, and is deleted when the
App is uninstalled. A correction already sent cannot be connected back to you
or individually withdrawn.
1.4 Device information
When you submit feedback, you may choose to include your operating system
version and device locale. This is optional and is
disabled by turning off the corresponding setting before sending.
1.5 Location information
If you grant location permission, the App uses your device’s location to
calculate distances, order results by proximity, and generate walking
directions. If you separately turn on Automatic Fair Day, the
App also uses your location to recognize when your device arrives at or leaves
the Minnesota State Fairgrounds. Arrival and departure events and your Fair Day
history are stored only on your device.
What this uses differs by platform, because the permissions do:
- Android. The App requests foreground location only. It
declares no background location permission and cannot check your location while
it is closed. Automatic Fair Day recognizes a visit from a location check made
while the App is open, so a Fair Day begins no earlier than the next time you
open the App on the grounds.
- iOS. If you grant “Always” location, the App may
recognize arrival and departure while it is closed, using the operating
system’s low-power visit and region monitoring rather than continuously
recording your location. “While Using” location also works; detection
then happens only while the App is open.
All location processing occurs entirely on your device. Your location is not
transmitted to us or to any third party. Weather information is requested using
the fixed coordinates of the Minnesota State Fairgrounds and not your location.
You may decline or revoke any location permission at any time in your device
settings; the App remains functional without it, and Automatic Fair Day is
optional in every case.
1.6 Motion and fitness information
If you switch on step counting in Settings, the App reads the number of
steps you have taken and the walking distance your device has estimated for
the current day, using the operating system’s motion sensors. This is
used only to display those two figures to you inside the App.
Motion and fitness information is processed entirely on your device. It is
not transmitted to us, is not included in the anonymous usage events described
in Section 1.2, and is not shared with any third party. It is not stored by the
App beyond the moment it is displayed. Step counting is off unless you turn it
on, may be turned off again at any time in Settings, and the permission may be
revoked in your device settings. The App remains fully functional without it.
The App does not read from, or write to, Apple Health or any other health
platform.
1.7 Notes you write
You may attach a note to any item you save. Notes are stored only on your
device, are never transmitted, and are deleted when you delete the item or
uninstall the App.
1.8 Information stored on your device
The following are stored locally and are not transmitted: your saved list and
any notes attached to them, your filter and display preferences, a local record
of items you have opened (used solely to order suggestions on your own device),
and cached map, schedule, and weather data.
1.9 Anonymous save counts
The App shows a “most saved” list so you can see which food stands
other people are planning to visit. When you save something, the App sends the
identifier of that stand or place to our server, which adds one to a running
total for it.
That request contains the identifiers and nothing else. It does not contain
your installation identifier, your device identifier, your location, the time
you saved it, the order in which you saved things, the rest of your list, or any
note you wrote. The totals are counts only. There is no record, on our server or
in our logs, that could be used to work out what any individual person saved, or
to link two saves to the same person.
Your saved list itself stays on your device. It is not uploaded, backed up to
us, or restored from us; deleting the App deletes it. Counts already added to a
total are anonymous and cannot be traced back to you, so they cannot be
individually withdrawn.
1.10 Anonymous trending counts
If you choose Share app analytics, the App may send the
identifier of a place when you open its detail page so the App can show a
rolling “Trending now” list. This is a shared aggregate total, not a
record of your visit history.
The request contains a place identifier and nothing else. It does not
contain your analytics identifier, device identifier, location, search text,
saved list, or a timestamp from your device. Our server groups counts into
hourly totals and does not retain individual open events. Turning analytics off
stops future contributions; totals already added are anonymous and cannot be
traced back to or removed for one person.
2. How We Use Information
- To provide, operate, and maintain the Services.
- To understand aggregate usage patterns and improve the App.
- To respond to feedback and support requests you send us.
- To diagnose and correct technical problems.
3. Legal Bases for Processing
Where the General Data Protection Regulation (GDPR) applies, optional usage
analytics, pin corrections, and feedback are processed on the basis of your
consent. You may withdraw analytics consent in Settings. You control pin
corrections and feedback by choosing whether to confirm or send each one.
4. Service Providers and Disclosure
We use the following third-party providers, each of which processes
information on our behalf and only as described:
- PostHog: product analytics and community pin correction
delivery, receiving the data and separate random identifiers described in
Sections 1.2 and 1.3.
- Web3Forms: form delivery, receiving the content of
feedback you submit.
- Cloudflare: website and content delivery, receiving
standard technical request information.
- OpenFreeMap: map tiles. Requesting a map tile
necessarily discloses the map area being displayed.
- Open-Meteo and the United States National Weather
Service: weather forecasts and severe weather alerts, requested using
the fixed coordinates of the fairgrounds.
We do not sell personal information, and we do not share personal
information with data brokers or advertising networks. We may disclose
information where required to do so by law or in response to valid legal
process.
Your live location, motion and fitness information, notes, and saved list are
never disclosed to any service provider or third party. They do not leave your
device. Community pin corrections contain map points for places, not the
device’s location. The anonymous per-stand save count described in Section 1.9
and the anonymous trending count described in Section 1.10 carry no identifier
of any kind and cannot be linked to you.
5. Tracking
The App does not track you across applications or websites owned by other
companies, does not use advertising identifiers, and contains no advertising or
third-party advertising software development kits. For this reason, the App
does not present the App Tracking Transparency prompt.
6. Data Retention
Optional app-usage events and confirmed pin corrections are retained
by our analytics provider for the period permitted under our plan with that
provider. Feedback messages are retained in the recipient email account for as
long as necessary to respond and to maintain a record of reported issues.
Information stored on your device is retained until you delete it or uninstall
the App.
7. Your Rights
Depending on your jurisdiction, you may have the right to request access to,
correction of, or deletion of personal information we hold about you, and to
object to or restrict certain processing. Because the App does not collect
information that identifies you, we are generally unable to associate any
request with a particular individual. You may delete all information stored on
your device by uninstalling the App. To exercise any right, or to ask a
question about this policy, contact us using the details in Section 11.
8. Children’s Privacy
The Services are intended for a general audience and are not directed to
children under 13. We do not knowingly collect personal information from
children. As described above, the App does not collect information that
identifies any user, of any age.
9. Security
Information transmitted by the App is sent over encrypted connections
(HTTPS). No method of transmission or storage is completely secure, and we
cannot guarantee absolute security.
10. Changes to This Policy
We may update this policy from time to time. The effective date at the top
of this page will be revised accordingly. If a change materially affects what
information leaves your device, we will state that change prominently at the top
of this page.
