Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Midway mobile application and the midwayfair.app website (together, “the Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. No Affiliation with the Minnesota State Fair

Midway is an independent, fan-made application. It is not affiliated with, endorsed by, or sponsored by the Minnesota State Fair or the Minnesota State Agricultural Society, and no intellectual property has been licensed to it. All Minnesota State Fair names, marks, and materials remain the property of their respective owners. Where information in the Services differs from information published by the Minnesota State Fair, the Minnesota State Fair’s own information governs.

2. License to Use the Services

Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use. You may not reverse engineer, decompile, scrape, bulk download, redistribute, or resell any portion of the Services or the data contained in them, except as permitted by the licenses described in Section 7 or by applicable law.

3. Accuracy of Information

Schedules, vendors, menus, locations, and amenity information are compiled from material published by the Minnesota State Fair and from OpenStreetMap, and are subject to change without notice. Events may be cancelled or rescheduled, vendors may change or close, and locations may be inaccurate.

Certain amenity locations are derived from the Minnesota State Fair’s printed map, which is an illustration rather than a survey. Positions derived in this way may differ from actual locations by several tens of meters. You should treat all information in the Services as a convenience and rely on official signage and the Minnesota State Fair’s own published information.

4. Walking Directions

Walking routes are generated from public map data and do not account for closures, construction, crowding, restricted areas, or gate operating hours. Routes are provided for general guidance only. You are responsible for your own safety and for observing all posted signage, barriers, and instructions given by event staff and public safety personnel. Do not rely on the Services for navigation in a manner that would put you or others at risk.

5. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PROVIDER OF THE SERVICES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, AND IN THOSE JURISDICTIONS LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

7. Third-Party Data and Attribution

Map data is © OpenStreetMap contributors and is available under the Open Database License (ODbL). Weather information is provided by Open-Meteo and by the United States National Weather Service. Schedule, vendor, and event information is published by the Minnesota State Fair. Photographs remain the property of their respective owners and are credited where they appear. A full list of sources is available in the App under Settings.

Midway’s geocoded vendor coordinate database is available under the ODbL on the Open Map Data page.

8. Changes to the Services and to These Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may revise these Terms from time to time; the effective date above will be updated accordingly. Continued use of the Services after a revision constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict of law provisions.
